If you have any questions, or do not understand any information within these Terms and Conditions, please contact Lockdown before booking. Lockdown will not be held responsible for cancelling your game (without refund) if you are in breach of the said Terms and Condition upon your arrival at the game centre. Before completion of your booking on the website, you will be asked to agree to these Terms and Conditions, so please ensure you fully understand them before booking.


These booking conditions, together with our privacy policy and any other written information are brought to your attention before we confirmed your booking the basis of your contract with Lockdown Escape Ltd trading as Lockdown, Ormskirk (“we”, “us” and “our”).

Please read these carefully as they govern the relationship between us, and set out our respective rights and obligations. In these Booking Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred

By making a booking, the first named person on the booking (“the Lead Name”) agrees on behalf of all persons detailed on the booking that:

·      He/she/they has read these terms and conditions and has the authority to and does agree to be bound by them;

·      He/she/they consents to our use of information in accordance with our Privacy Policy;

·      He/she/they at least 18 years of age and resident in the United Kingdom and where placing an order for services with age restrictions declares that he/she/they and all members of the party are of the appropriate age to purchase those services;

·      all information given to us is true and accurate

 

INJURY WAIVER

By choosing to participate in an escape room activity at Lockdown Escape Rooms; you understand that participation exposes you and the members of your part to personal injury risk. You, being fully aware of this risk agree to participate and release Lockdown Escape Rooms, the company, its employees or anyone associated with this company from any liability from property damage, personal injury or any other claims arising from, or in connection with, your participation, including game play and any other activity carried out on the premises. You (the person making this booking) agree that you have informed all members of your party of all of these conditions and that they agree to participate knowing this. You are aware that you will be responsible for the welfare of all members of your party while on the premises and while taking part in any activity with Lockdown Escape Rooms. You also agree, as the lead name on this booking that you are responsible for the agreement to participate by anyone under the age of 18 and that you accept full responsibility for their actions and welfare.

You acknowledge that you are fully aware of the terms of this waiver, that you agree to our terms and conditions, and that your participation and attendance confirms your agreement with this.


REQUIREMENTS & SAFETY WHILE PLAYING

Escape Rooms are a fun activity, but while every precaution as been taken to ensure games are safe, each room and area in the building will carry elements of risk to loss, damage, or injury. While there are extensive risk assessment and procedures in playe at Lockdown, it is the responsibility of each person attending to ensure they or the person/s they are supervising, are cautious, attentive, and safe. Escape rooms contain games that may pose hazards, or slips, trips, bumps, bruises, falls etc… Upon booking and prior to playing, all players accept that they are fully responsible for their actions and will not hold Lockdown Escape Ltd, or any of its employees responsible for any loss, damage, or injury occurring during their visit.

Our building is, unfortunately, not wheelchair accessible. There are stairs and steps into the building and to and from all rooms. All players must be able to suitable, quickly and safely navigate these in the event of evacuation. If this is not possible, we will unfortunately not be able to facilitate your attendance.


Players are advised that, while our games are mostly mentally challenging, some elements of our games will involve bending, reaching, crawling, kneeling, and entering confined spaces. Some of our games contain extra rooms and crawl-spaces. Before booking, players agree that they understand these elements of the games and that they may be required to enter these spaces to fully complete the room. All of these areas are monitored by CCTV and extensive risk assessments are in place. When booking, players agree that:

-They and their team-mates are happy using and entering confined spaces and crawl spaces

-They have no medical conditions that could become aggravated in these areas, or would prevent safe exit in the event of an emergence

-They agree to act with due care, caution, and attention while using these areas

-If one of their party enters these spaces, it will not leave a person isolated who they are responsible for supervising during the game

-They agree to listed to, and be aware of all Game Maters warning and advice before and during the game

-They understand that any loss, damage, or injury will be the sole responsibility of the player or players in the room and they will not hold Lockdown Escape Ltd or any of its employees responsible.

YOUR BOOKING WITH US

The person who signs the booking form or completes the booking online or by telephone will be the “lead name” for the purposes of the booking. The lead name must be 18 years of age or over at the time of booking.

The lead name is responsible for complete payment of the total booking price, which can include cancellation or amendment charges. The lead name must confirm that all the other members of the party agree to be bound by these terms and conditions and provide accurate and full information to the remainder of the group in relation to the booking, including any subsequent changes.

If you are booking on behalf of a group, please make sure that you have the consent of all people in your party before making a booking and that all members of your party have read and agree to be bound by these terms and conditions.

A booking is made with us when a) you tell us that you would like to accept our quotation; and b) you pay us for the booking; and c) we issue you with a booking confirmation. We reserve the right to return your booking money and decline to issue a confirmation at our discretion. A contract will exist between you and us when we issue a confirmation invoice to the lead name that will confirm the details of your booking, which may be either by post or e-mail. Upon receipt, if you believe that any details on the confirmation information or any other document are wrong you must advise us immediately as changes cannot be made later and it may harm your rights if we are not notified of any inaccuracies.

Should any additional members of the group be added at a later date, it remains the responsibility of the lead name to ensure that any such members agree to be bound by these terms and conditions and are in receipt of all relevant information relating to the booking.

For the avoidance of doubt, nothing in this agreement shall limit or exclude our liability for death or personal injury resulting from our negligence, for fraud or fraudulent misrepresentation or for any other liability the exclusion or limitation of which is not permitted by English law.

PLEASE BE ADVISED: If you are intoxicated when you reach the game centre you will not, under any circumstances, be allowed to play the game and your will not be refunded.


Lockdown will also offer you the chance to have your photo take after your game, By allowing this, you agree to allow Lockdown to use these photos for social media posts, and other promotional materials. You agree that you will allow this without a claim to the rights of the images or payment for their use.


 AGE RESTRICTIONS

Persons must be 10+ to play the games, provided the Lead Name on the booking is aged 18 or over at the time of the booking, The Lead Name on the booking confirms that they shall accept full responsibility for the welfare of all members of their group who are aged under 18. A playable group with members aged 17 or under must include a playable person who is at least 18 years old who will be responsible for the supervision and safety of all players while on the premises.


LAW

These Booking Conditions and any agreement to which they apply are governed in all respects by English law. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so.


SPECIAL REQUESTS

Any special requests must be advised to us before booking. Although we will endeavour to meet any special requests, we regret we cannot promise that any requests will be complied with unless we have specifically confirmed this in writing. Please ensure you are happy with our ability to meet any request before booking.

Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met.

Please ensure you contact Lockdown Escape Ltd prior to booking if you have any concerns or requests about your booking. Please ensure you are satisfied with the responses, which we will provide, in writing, before you book. Any issues arising after booking may result in your game or visit being cancelled or hampered and refunds will not be issued.

Please be aware that, unfortunately, Lockdown, Ormskirk is not wheelchair accessible due to the nature of our building.


DISABILITIES & MEDICAL PROBLEMS

If you or any member of your party has any medical problem or disability which may affect the booking arrangements of that person, please tell us before you confirm your booking so we can advise as to the suitability of the chosen booking. In any case, you must give us full details in writing before booking.

We may require you to produce a doctor’s certificate certifying that you are fit to participate in the booking. Acting reasonably, if we are unable to properly accommodate the needs of the person/s concerned, we advise you not to complete your booking. If you did not give us full details before booking, we will cancel it and impose applicable cancellation charges when we become aware of these details. This will include the non-refunding of your booking.


PRICING CHANGES

We reserve the right to amend the price of bookings and the the rooms at any time, without notice.

  

SMOKING AND VAPING

Smoking and vaping is strictly prohibited in the building.


DAMAGES BY YOU TO ANY PROPERTY

If you or any of your party damages or takes our property, you agree that Lockdown Escape Ltd can charge, without prior notice, the payment method on file, immediately, in compensation for these damages or losses. You agree that, as the lead name on the booking, you allow us to take this payment to which the amount chargeable will solely be decided by Lockdown escape Ltd.


CANCELLATION OR CHANGES BY YOU

If you wish to change any part of your booking arrangements after our confirmation invoice has been issued, you must inform us in writing as soon as possible. This should be done by the Lead Name. Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. Where we can meet a request, we reserve the right, entirely at our discretion, to charge you an administration fee of £10 per person per change as well as any applicable rate changes or extra costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers.

If we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you. A cancellation fee may be payable.

Please Note: Certain arrangements may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements.

If you wish to change any part of your booking arrangements after our confirmation invoice has been issued, you must inform us in writing as soon as possible. This should be done by the Lead Name. Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. If we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you. A cancellation fee of £10 may be payable.

If you wish to cancel or move your booking you must inform us immediately. All bookings are none-refundable. A request to cancel or move your booking must be made in writing. The request will not guarantee we will be able to meet your request and a decision will be the at the sole discretion of management. If we agree to move your booking, you must choose a rebooking date within 7 days of your original booking date. You will only be permitted to move a booking once. Moving bookings are only permitted if you make the request to us, in writing, at least 48hours before your original booking.

If you wish to add players to your booking, this is permitted up until the time of arrival, as long as the total number of players in any one room does not exceed 5. Additional players must be paid for, in full, immediately, before they will be permitted to play.

REMOVING PLAYERS FROM YOUR BOOKING

If you wish to remove players from your booking and there is LESS THAN 48 HOURS until your booking start time, you must inform us, in writing. However, you will not be entitled to any refund of credit for these player/s who are/is not attending. Your booking will still be permitted to go ahead with less players than originally booked for. If you chose to remove players from your booking, you may not reduce the total number to less than two. If you chose to remove players, you must ensure that there is at least one adult remaining in the team. Removing players is only permitted for original bookings (not bookings that have previously been rescheduled) Removing players is also not permitted for bookings that have been booked using a gift voucher.

If you wish to remove players from your booking and there is MORE THAN 48 HOURS until your booking start time, you must inform us, in writing. You will not be entitled to any refund for these player/s who are/is not attending, however you may be permitted to receive credit for these players who are/is not attending. The issuing of credit will be at the discretion of management. Any credit will be issues via electronic gift voucher to the booking email address provided- this voucher will expire 1 month from the date of booking. To extend the length of a gift voucher, please see the Gift Voucher Terms and Conditions. Your booking will still be permitted to go ahead with less players than originally booked for. If you chose to remove players from your booking, you may not reduce the total number to less than two. If you chose to remove players, you must ensure that there is at least one adult remaining in the team. Removing players is only permitted for original bookings (not bookings that have previously been rescheduled) Removing players is also not permitted for bookings that have been booked using a gift voucher. Only 1 gift voucher can be redeemed per booking. gift vouchers can not be used in conjunction with other gift vouchers or discount codes. Gift vouchers can not be used to purchase other gift vouchers.


FAILING TO SHOW FOR YOUR BOOKING

If you fail to show for your booking you will not be permitted to rebook or be entitled to a refund. If you think that you will not be able to attend your booking, please contact us immediately.


ARRIVING LATE FOR YOUR BOOKING

ALL players must arrive AT LEAST 15 minutes before your booking time. This time is allocated for your safety briefing and game introduction. If ALL players do not arrive at least 15 minutes before the game start time, your game will not go ahead and we will class this as failing to show for your booking; and you will not be permitted to rebook or be entitled to a refund.


CANCELLATIONS OR CHANGES BY US

The arrangements for Lockdown, Ormskirk are put together in good faith in advance and we must therefore reserve the right to make alterations to and correct any errors to the event details before and after your booking has been confirmed.

Most of these changes will be minor and we will advise you of them at the earliest possible date. We also reserve the right in any circumstances to cancel your booking.

If we have to make a major change or cancel your booking, we will tell you as soon as possible. In these cases we will offer you either a refund or an alternative booking time. In case of forced closure or changes that are not specific to your individual booking (e.g. government Lockdowns due to such instances as COVID-19,) we will offer you an alternative booking date; but will not be able to offer refunds.

You must notify us of your choice within 7 days of our offer. If you fail to do so we will assume that you have chosen to accept the change or alternative booking arrangements.

Very rarely, we may be forced by “force majeure” to change or terminate your booking. If this situation does occur, we regret we will be unable to make any refunds, pay you compensation or meet any costs or expenses you incur as a result.



OUR LIABILITY TO YOU

We will not be responsible or pay you any compensation for any injury, illness, death, loss (including loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

1.          the act(s) and/or omission(s) of you or another member of your party; or

2.        the act(s) and/or omission(s) of a third party not connected with the provision of the services contracted for and which were unforeseeable or unavoidable; or

3.       unusual and unforeseeable circumstances beyond our or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised (including, without limitation, the circumstances outlined in the section entitled “Force Majeure” below); or

4.        an event which we or the supplier of services, even with all due care, could not foresee or forestall.



YOUR RESPONSIBILITIES AND LIABILITY

We want all our customers to have an enjoyable experience and Lockdown, Ormskirk. Please remember that you are responsible for your actions and the effect they may have on others. If we, or another person in authority, believe:

1.     Your actions could distress, upset, annoy or disturb other customers, our suppliers or our own staff, or put them in any risk or danger, or damage property; or

2.    You are unfit to partake in your activity, or be present on the premises;

 We may prevent you from continuing your booking


Remember, you are responsible for your safety and that you are responsible for the condition of the property you occupy. We are not responsible for any accidents which occur in our building/s due to your inappropriate or irresponsible behaviour, or for any accidents which occur anywhere on properties because of any items or property which you have broken and/or have left in a way in which injury can result.

You are responsible for your own timekeeping. If you do not arrive on time, we reserve the right to cancel your booking.

You must be in a fit state to enter the Lockdown, Ormskirk building. If you are not we will deny your entry.



FORCE MAJEURE

Except where otherwise specified in these conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is affected by reason of circumstances amounting to Force Majeure.

In these booking conditions “Force Majeure” means any event which we or the supplier of the services in question could not, even with all due care, foresee or avoid, such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, government restrictions on movement, pandemic restrictions and similar events beyond our control may constitute Force Majeure.


Gift Vouchers

All gift vouchers are purchased via our website and come with a unique redemption code, which can be used at checkout. These codes are single use and codes will not be reissued under any circumstance. It is the responsibility of the person purchasing the voucher to ensure that the code is kept secure and. Once you have completed purchase, you will be taken to a page to create your customised voucher. Here you can add a personal message. Once complete, you will be able to download your PDF voucher. This can be sent to the recipient as either a virtual voucher, or it may be printed.

Each voucher comes with a unique single-use code which is redeemed at checkout when booking through our website.

We can not accept returns of gift vouchers.

Once a gift voucher has been purchased, it is not refundable or exchangeable. All gift vouchers must be redeemed by the expiry date. If your gift voucher expires, you can contact us to reactivate the voucher. This will incur a £5 reactivation fee charge for every month it has expired. This is only possible for vouchers that expired 6 months ago or less. You may extend an expired voucher multiple times to a maximum of 6 total months. For example, you may extend the voucher for a maximum of 6 months in one purchase, or 6 individual payments of 1 month each. Please remember that a voucher is only permitted to be extended to a maximum of 6 extra month from the original expiration date.
